This Privacy Policy explains how  OnsStay (referred to as “OnsStay,” “we,” “us,” or “our”) collects, uses, processes, and discloses your  information when you access or use  our platform, including our website, mobile applications, and services (collectively, the “Platform”).

Profile Information: Details you choose to add to your  public profile, such as your city, country, and a personal description.

Identity Verification Information: To help create and maintain a trusted environment, we may  collect identity verification information (e.g., images of your government-issued ID, passport, national ID card, or driving license) or other authentication information.

Payment Information: Financial account information (e.g., bank account details, credit card information) as necessary to process payments and comply with applicable law. This information is securely processed by our third-party payment processors.

Listing Information (for Hosts): Details about the properties you list, including location (address, city, country), property type, number of rooms, amenities, descriptions, photos, videos, and availability.

Booking Information (for Guests): Details about your  bookings, including check- in/check-out dates, number of guests, and special requests.

Communications: Information you provide when you communicate with  other users, OnsStay customer support, or participate in surveys, forums, or promotions.

Other  Information: Any other information you voluntarily provide to us.

2.2. Information We Automatically Collect from  Your Use of the

Platform

When you use  our Platform, we automatically collect information about your  usage and interactions. This information is necessary for the adequate performance of the contract between you and us, to enable us to comply with  legal  obligations, and given  our legitimate interest in being able to provide and improve the functionalities of the Platform.

Usage Information: We collect information about your  interactions with  the Platform, such as the pages or content you view, your  searches for listings, bookings you have made, and other actions on the Platform.

Log Data and Device Information: We automatically collect log data and device information when you access and use  the Platform, even if you have not created an account or logged in. That information includes, among other things: IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, crash data, cookie data, and the pages you’ve viewed or engaged with  before or after using the Platform.

Location Information: When you use  certain features of our Platform, we may collect information about your  precise or approximate location as determined by data such as your  IP address or mobile device’s GPS. Most mobile devices allow you to control or disable the use  of location services for applications in the device’s settings menu.

Background Information: For hosts, to the extent permitted by applicable laws, we may  obtain reports from  public records of criminal convictions or sex offender registrations. We may  use  your  information, including your  full name and date of birth, to obtain such reports.

Other  Sources: To the extent permitted by applicable law, we may  receive additional information about you, such as demographic data or fraud detection information, from  third-party service providers and/or partners, and combine it with  information we have about you.

3. How We Use Information We Collect

We use, store, and process information about you to provide, understand, improve, and develop the OnsStay Platform, and to create and maintain a trusted and safer environment.

3.1. Provide, Improve, and Develop the Platform

• Enable you to access and use  the Platform.

• Enable you to communicate with  other users.

• Operate, protect, improve, and optimize the OnsStay Platform and experience, such as by performing analytics and conducting research.

• Personalize or customize your  experience by, for example, ranking search results or showing listings based on your  search and booking history.

• Enable you to access and use  the payment services.

• Provide customer service.

• Send you service or support messages, updates, security alerts, and account notifications.

3.2. Create and Maintain a Trusted and Safer Environment

• Detect and prevent fraud, spam, abuse, security incidents, and other harmful activity.

• Conduct security investigations and risk assessments.

• Verify or authenticate information or identifications provided by you.

• Comply with  our legal  obligations.

• Enforce our Terms and Conditions and other policies.

• Resolve any disputes with  any of our users and enforce our agreements with  third parties.

3.3. Provide, Personalize, Measure, and Improve Our Advertising and

Marketing

• Send you promotional messages, marketing, advertising, and other information that may  be of interest to you based on your  preferences (including information about OnsStay or partner campaigns and services).

• Personalize, measure, and improve our advertising.

• Administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by OnsStay or its third- party partners.

4. Sharing and Disclosure

We may  share your  information with  third parties in the following circumstances:

4.1. With Your Consent

We may  share your  information when you give us explicit consent to do so.

4.2. Between Members (Hosts and Guests)

To facilitate bookings and interactions between hosts and guests, we may  share certain information:

• When a booking is confirmed, we share certain information between the host and guest (e.g., full name, contact details, property address, check-in/check-out times).

• When you submit content to the Platform (e.g., reviews, public profile information), this content may  be publicly visible.

4.3. Service Providers

We use  a variety of third-party service providers to help us provide services related to the OnsStay Platform. Service providers may  be located inside or outside of the European Economic Area (“EEA”). For example, service providers may  help us with:

• Payment processing

• Identity verification

• Customer service

• Marketing and advertising

• Data analytics

• Security operations

These providers have limited access to your  information to perform these tasks on our behalf and are  contractually obligated to protect it and use  it only for the purposes for which it was disclosed.

4.4. Compliance with Law, Responding to Legal Requests, Preventing

Harm, and Protection of Our Rights

OnsStay may  disclose your  information to courts, law enforcement, governmental authorities, or authorized third parties, if and to the extent we are  required or permitted to do so by law or if such disclosure is reasonably necessary:

OnsStay.

• to respond to a valid legal  request relating to a criminal investigation or alleged or suspected illegal  activity or any other activity that may  expose us, you, or any other of our users to legal  liability.

• to enforce and administer our Terms and Conditions or other agreements with users.

• to protect the rights, property or personal safety of OnsStay, its employees, its users, or members of the public.

If OnsStay undertakes or is involved in any merger, acquisition, reorganization, sale of assets, bankruptcy, or insolvency event, then we may  sell, transfer or share some or all of our assets, including your  information in connection with  such transaction or in contemplation of such transaction (e.g., due diligence).

4.6. Aggregated Data

We may  also share aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

You have certain rights regarding your  personal information, subject to local  laws. These

rights may  include:

Access and Portability: You have the right to request copies of your  personal information held by us.

Rectification: You have the right to request that we correct any inaccurate or incomplete personal information.

Erasure: You have the right to request that we delete your  personal information, subject to certain exceptions (e.g., if we are  legally required to retain it).

Objection to Processing: You have the right to object to the processing of your personal information for certain purposes (e.g., direct marketing).

Restriction of Processing: You have the right to request that we restrict the processing of your  personal information in certain circumstances.

6. Data Retention

We retain your  personal information for as long  as necessary to provide the services you have requested, to comply with  our legal  obligations, resolve disputes, and enforce our agreements. Once  your  information is no longer needed for these purposes, we will securely delete or anonymize it.

We are  continuously implementing and updating administrative, technical, and physical security measures to help protect your  information against unauthorized access, loss, destruction, or alteration. Some of the safeguards we use  are  firewalls and data encryption, and information access controls. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security.

We reserve the right to modify this Privacy Policy at any time in accordance with  this provision. If we make changes to this Privacy Policy,  we will post the revised Privacy Policy on the Platform and update the “Effective Date” at the top of this Privacy Policy. We will also provide you with  notice of the modifications by email or through the Platform. If you disagree with  the revised Privacy Policy,  you may  cancel your  account. If you do not cancel your  account before the date the revised Privacy Policy becomes effective, your  continued access to or use  of the Platform will constitute acceptance of the revised Privacy Policy.
